Welcome to Movicore. “We”, “us” and “our” refer to Movicore. We operate this shop and website, including its information, content, features, tools, products and services, to provide you, the customer, with a curated shopping experience (the “Services”). Movicore is powered by Shopify, which enables us to provide the Services.

These terms and the policies referred to in them (the “Terms of service” or “Terms”) describe your rights and responsibilities when using the Services. Read them carefully: they contain important information about legal rights, disclaimers and limitations of liability. By viewing, interacting with or using the Services, you agree to these Terms and our privacy policy. If you do not agree, you must not use the Services.

1. Access and accounts

By agreeing, you represent that you are at least the age of majority in your state or province of residence and have consented to dependent minors using the Services on devices you own, purchase or manage.

Using, browsing or purchasing through the Services may require details such as your email, billing address, payment method and shipping address. You represent that the information provided is accurate, current and complete and that you have all necessary rights to provide it.

You are solely responsible for securing your account credentials and all account activity. You may not transfer, sell, assign or license your account to another person.

2. Our products

We make every effort to represent products and services accurately. Colours and appearance may differ from your screen because of the device and settings used. We do not guarantee that appearance or quality will meet expectations or be identical to the display.

Product descriptions may change at any time without notice at our discretion. We may discontinue products or limit quantities offered to a person, region or jurisdiction on a case-by-case basis.

3. Orders

Placing an order is an offer to purchase. Movicore may accept or reject it for any reason at its discretion. An order is not accepted until Movicore confirms acceptance, and payment must first be received and processed. Review your order carefully before submission, as cancellation requests may not be possible after acceptance.

If we reject, change or cancel an order, we will try to notify you using the email, billing address or telephone provided. Purchases are subject to returns or exchanges only under our refund policy.

You represent that purchases are for personal or household use, not resale or export for commercial purposes.

4. Prices and billing

Prices, discounts and promotions may change without notice. The price charged is the price effective when the order is placed and stated in the confirmation email. Unless expressly stated otherwise, published prices exclude tax, shipping, handling, customs and import charges.

Our online prices may differ from those offered by third-party physical or online shops. Promotions may have separate terms; if they conflict with these Terms, the promotion's terms prevail.

You agree to provide current, complete and accurate purchase, payment and account information and promptly update details, including email, card numbers and expiry dates, so that transactions can be completed and we can contact you.

You represent that card information is true, accurate and complete, that you are authorised to use the card, that its issuer will honour the charges, and that you will pay charges at the published prices, including applicable shipping, handling and taxes.

5. Shipping and delivery

We are not responsible for shipping or delivery delays. Delivery times are estimates only and are not guaranteed. We are not responsible for carrier, customs or other delays outside our control. Once products are handed to the carrier, title and risk pass to you.

6. Intellectual property

The Services, including trademarks, brands, text, displays, images, graphics, product reviews, video, audio and their design, selection and arrangement, belong to Movicore, its affiliates or licensors and are protected by US and other intellectual property laws.

These Terms permit personal, non-commercial use only. Without our prior written consent, you may not reproduce, distribute, modify, create derivative works, publicly display or perform, republish, download, store or transmit material from the Services. Unless expressly stated, no patent, trademark, copyright or other intellectual property licence or right of Movicore, Shopify or any third party is granted. Unauthorised use may infringe applicable intellectual property laws. All rights not expressly granted are reserved.

Movicore names, logos, product and service names, designs and slogans are trademarks of Movicore, its affiliates or licensors and require prior written permission to use. Shopify's name, logo, product and service names, designs and slogans are Shopify trademarks. Other marks belong to their respective owners.

7. Optional tools

The Services may provide access to third-party tools that we do not monitor, control or contribute to. Access is provided “as is” and “as available”, without warranties, representations, conditions or endorsement. We accept no liability arising from your use of optional third-party tools.

Use is at your own discretion and risk. Ensure you understand and accept the provider's terms. Future features, tools or resources offered through the Services also form part of the Services and are subject to these Terms.

8. Third-party links

The Services may include third-party materials, links or embedded functionality. We are not responsible for examining, evaluating or ensuring the accuracy of third-party materials or sites. Accessing them is at your own risk.

We are not responsible for harm or damage related to third-party sites or purchases or use of their products, services or resources. Read their policies and practices before transacting. Direct complaints, claims and questions about third-party products or services to the relevant third party.

9. Relationship with Shopify

Movicore is powered by Shopify, which enables us to provide the Services. However, sales and purchases in this shop are directly with Movicore. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Movicore, including injury, damage or loss arising from purchased products or services. You expressly release Shopify and its affiliates from claims, damages and liabilities arising from or related to your purchases and transactions with Movicore.

10. Privacy policy

Personal information collected through the Services is subject to our privacy policy. Certain information may also be subject to Shopify's privacy policy. Using the Services acknowledges that you have read these policies.

Shopify hosts the Services and collects and processes information about access and use to provide and improve them. Information you submit will be transmitted to and shared with Shopify and third parties that may be located outside your country. 11. Feedback

If you submit, upload, publish, email or otherwise transmit ideas, suggestions, comments, reviews, proposals, plans or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display it in any medium for any purpose, including commercial purposes. This includes operating, providing, evaluating, improving and promoting the Services and meeting obligations and enforcing rights under these Terms.

You represent that you own all necessary rights, have disclosed compensation or incentives related to the submission, and that Feedback complies with these Terms. We are not required to keep it confidential, compensate you or respond.

We may, but need not, monitor, edit or remove Feedback that we consider unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene, otherwise objectionable or infringing intellectual property or these Terms.

Your Feedback must not infringe copyright, trademarks, privacy, personality or other rights; contain unlawful, abusive, obscene or libellous material; or contain viruses or malware affecting the Services or related websites. You must not use a false email, impersonate someone else or mislead us or others about its origin. You alone are responsible for your Feedback and its accuracy. We accept no responsibility for Feedback posted by you or third parties.

12. Errors, inaccuracies and omissions

Information on the Services may contain errors, inaccuracies or omissions concerning descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We may correct these, update information or cancel orders at any time without notice, including after an order is submitted.

13. Prohibited uses

You may use the Services only for lawful purposes. You must not use them directly or indirectly for unlawful or malicious purposes; breach applicable international, federal, state, provincial or local laws; infringe intellectual property; harass, abuse, insult, harm, defame, disparage or intimidate employees or others; transmit false or misleading information; send, knowingly receive, upload, download, use or reuse material contrary to these Terms; send junk mail, chain letters or spam; impersonate a person or entity; or restrict others' use or enjoyment or expose Movicore, Shopify or users to harm or liability.

You must not upload or transmit viruses or malicious code; reproduce, duplicate, copy, sell, resell or exploit any part of the Services; collect or track others' personal information; engage in spam, phishing, pharming, pretexting, spidering, crawling or scraping; or interfere with or circumvent security features of the Services, related sites or the Internet. We may suspend, disable or terminate your account without notice for violations.

14. Termination

We may terminate this agreement or access to all or part of the Services at our discretion, at any time without notice. You remain responsible for sums due up to and including termination.

Provisions concerning intellectual property, Feedback, termination, warranties, limitation of liability, indemnification, severability, waiver, entire agreement, assignment, governing law, privacy and any provision intended by nature to survive remain in force.

15. Disclaimer of warranties

Information is made available for general information only. We do not warrant accuracy, completeness or usefulness. Reliance is at your own risk. We disclaim liability arising from reliance by you, other visitors or anyone aware of the material.

UNLESS EXPRESSLY STATED BY MOVICORE, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, INCLUDING IMPLIED MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE OR NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE USE. SOME JURISDICTIONS LIMIT OR PROHIBIT SUCH EXCLUSIONS, SO THEY MAY NOT APPLY TO YOU.

16. Limitation of liability

TO THE EXTENT PERMITTED BY LAW, MOVICORE, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, SUPPLIERS AND LICENSORS, AND SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR INJURY, LOSS, CLAIMS OR DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, REVENUE, SAVINGS OR DATA, REPLACEMENT COSTS OR SIMILAR DAMAGE, WHETHER BASED IN CONTRACT, TORT INCLUDING NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, ARISING FROM USE OF THE SERVICES OR PRODUCTS, OR ANY RELATED CLAIM, INCLUDING ERRORS OR DAMAGE RESULTING FROM CONTENT OR PRODUCTS POSTED, TRANSMITTED OR MADE AVAILABLE THROUGH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY.

17. Indemnification

You agree to indemnify, defend and hold harmless Movicore, Shopify and our affiliates, partners, officers, directors, employees, agents, contractors, licensors and service providers against loss, damage, liability or claims, including reasonable legal fees payable to third parties, resulting from your breach of these Terms or incorporated documents, violation of law or third-party rights, or access to and use of the Services.

We will notify you of covered claims; delayed notice does not release you unless materially prejudiced. We may control defence and settlement at your expense, including choice of lawyer, but will not settle a claim imposing non-monetary obligations on you without your consent, not to be unreasonably delayed. You will cooperate, including by providing relevant documents.

18. Severability

If a provision is unlawful, void or unenforceable, it remains enforceable to the fullest extent permitted by law and its unenforceable part is severed. This does not affect other provisions' validity or enforceability.

19. Waiver and entire agreement

Failure to exercise a right or provision is not a waiver. These Terms and policies or operating rules published here or concerning the Services form the entire agreement, govern use and supersede previous or current oral or written agreements, communications and proposals, including earlier versions. Ambiguity is not construed against the drafting party.

20. Assignment

You may not delegate, transfer or assign this agreement or your rights or obligations without our prior written consent; attempts are void. We may transfer, assign or delegate these Terms and our rights and obligations without your consent or notice.

21. Governing law

These Terms and separate agreements under which we provide Services are governed and construed under the federal and state or territorial courts of Movicore's jurisdiction. You and Movicore consent to those courts' jurisdiction and venue.

22. Headings

Headings are for convenience only and do not limit or affect these Terms.

23. Changes to these Terms

The current version is available on this page. We may update, change or replace any part by posting changes on the website. You are responsible for checking periodically. We will notify material changes in accordance with applicable law, effective on the date stated. Continued access or use after changes are posted means acceptance.
